DPDP Act 2023 B2B & B2C

1. About WeXL Edu and these Terms

WeXL Edu Limited (“WeXL Edu”, “we”, “us”, “our”) is a company incorporated under the Companies Act, 2013 (CIN: U85499TG2020PLC142487; formerly known as WeXL Edu Private Limited, CIN: U80904TG2020PTC142487). We operate AI-powered learning platforms including AI BET (AI Benchmarking English Tool), FluentEdge, and the AI-Powered Academic Excellence Program (together, “the Platform”).

These Terms of Use govern access and use of the Platform by all users — whether you are an institution that has entered into a Service Agreement with us (B2B), or an individual student who has purchased a plan directly (B2C). By registering, logging in, or using the Platform, you agree to be bound by these Terms.

2. Who May Use the Platform

  • Institutional users (B2B) — schools, colleges, and educational institutions that have executed a valid Master Service Agreement with WeXL Edu.
  • Individual student users (B2C) — students who register and purchase a plan directly on the Platform, including those who arrive via social media advertisements.
  • Teacher and administrator users — individuals authorised by a licensed institution to manage or monitor student activity.

Users must be at least 13 years of age. Users between 13 and 18 years of age must have a parent or guardian register on their behalf and accept these Terms.

3. Account Registration

To access the Platform you must create an account by providing accurate, complete, and up-to-date information including your name and email address. You are responsible for keeping your password confidential, all activity that occurs under your account, and notifying us immediately at support@wexledu.com if you suspect unauthorised use of your account.

One person may hold only one active account. Creating multiple accounts to circumvent access restrictions or refund policies is prohibited.

4. Licence and Access

Subject to these Terms and any applicable purchase or service agreement, WeXL Edu grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your own lawful educational purposes during the applicable subscription or licence period. This licence does not permit you to sublicense, resell, transfer, reverse-engineer, decompile, or extract any part of the Platform, its AI models, or its content.

5. Acceptable Use

You agree to use the Platform only for legitimate educational purposes. You must not post or share unlawful, offensive, or misleading content; attempt unauthorised access to other accounts or data; use automated scripts or bots; impersonate any person; or use the Platform to build a competing service.

Warning: Violation of these rules may result in immediate account suspension and legal action under the Information Technology Act, 2000.

B2C — Individual Students

6. Purchasing a Plan or Course B2C

  • You have reviewed the plan description and are purchasing the product described
  • Access to your purchased plan is personal to you and non-transferable
  • The plan is licensed, not sold — you receive access rights, not ownership of any content
  • Your access to the content will continue for the period stated at the time of purchase

WeXL Edu reserves the right to update or improve course content. If we discontinue a product for legal or policy reasons, you will be entitled to a refund on a pro-rata basis for unused access.

7. Pricing, Promotions and Coupons B2C

Prices displayed on the Platform are inclusive of applicable taxes unless otherwise stated. WeXL Edu may run time-limited promotional campaigns, including discounts advertised on social media.

  • Promotional codes and coupons are valid for a single use per account and may carry an expiry date
  • WeXL Edu reserves the right to modify, withdraw, or extend promotions at any time
  • Promotional credits are non-transferable and cannot be exchanged for cash

8. Payments and GST B2C

All payments are processed securely through our authorised payment gateway partners. WeXL Edu accepts UPI, debit/credit cards, net banking, and other methods displayed at checkout.

  • All prices are in Indian Rupees (INR) unless otherwise stated
  • GST is applicable at the rate prescribed under applicable law and will be reflected in your tax invoice
  • For B2B institutional clients, a valid GSTIN must be provided for B2B invoices
  • WeXL Edu is not liable for any additional charges imposed by your bank or payment provider
9. Refund and Cancellation Policy B2C

No Refund Policy: All sales on the WeXL Edu Platform are final. Once a plan, course, or subscription is purchased and access is granted, no refunds will be issued under any circumstances, including but not limited to change of mind, non-usage, dissatisfaction with AI-generated content, or failure to complete the course.

  • Discontinued product exception: If WeXL Edu discontinues a product entirely for legal or policy reasons before the end of your access period, you will be entitled to a pro-rata refund for the unused access period only.
  • Technical fault exception: If the Platform is unavailable for more than 72 continuous hours due to a fault on WeXL Edu’s part, you may request a proportional credit to your account.
  • Promotional purchases: Purchases made using a promotional code or at a discounted price are strictly non-refundable.
  • Subscriptions: Cancellation of auto-renewal takes effect from the next billing cycle — no refund is provided for the current billing period already paid.
  • B2B institutional clients: Refund and cancellation terms are governed exclusively by your signed Master Service Agreement with WeXL Edu.

To raise a billing concern (not a refund request), email support@wexledu.com with your order ID.

10. Subscriptions and Auto-Renewal B2C

  • Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date
  • You will be notified by email at least 7 days before your subscription renews
  • To cancel auto-renewal, contact our support team at support@wexledu.com
  • Cancellation takes effect at the end of the current billing period — you retain access until that date
  • No partial refunds are provided for unused days in a current billing period following cancellation

11. Social Media Advertising B2C

WeXL Edu promotes its products through paid advertisements on platforms including Instagram, Facebook, YouTube, and other digital channels.

  • WeXL Edu is solely responsible for fulfilling the purchased product; the social media platform is not a party to your purchase
  • WeXL Edu does not authorise third parties to make commitments on our behalf via comments, direct messages, or unofficial pages
  • If you believe an advertisement was misleading, please contact us at support@wexledu.com

1. Who We Are and Scope

WeXL Edu Limited is the data fiduciary for all personal data processed through AI BET, FluentEdge, and the AI-Powered Academic Excellence Program (CIN: U85499TG2020PLC142487; formerly known as WeXL Edu Private Limited, CIN: U80904TG2020PTC142487). This Privacy Policy applies to both institutional (B2B) and individual student (B2C) users, including users who reach the Platform via social media advertisements. We comply with the Digital Personal Data Protection Act, 2023 (DPDP Act) and other applicable Indian law.

2. What Data We Collect

  • B2C individual students: Name, email address, date of birth (for age verification), state/city, payment transaction reference, purchased plan details, course progress, assessment scores, and learning activity logs.
  • B2B institutional users: Institution name, address, authorised contact details, GSTIN, and administrator credentials.
  • Teacher/administrator users: Name, email, employee ID, and role.
  • Technical data (all users): IP address, device type, browser, login timestamps, page views, and clickstream data for security and platform improvement.

We do not collect financial card or bank account details directly — payments are processed by authorised gateway partners.

3. How We Collect Data from B2C Users B2C

  • Ad interaction: When you click a WeXL Edu advertisement on Instagram, Facebook, YouTube, or other platforms, the social media platform may share limited signals with us through their advertising APIs solely to measure campaign effectiveness.
  • Lead forms: If you submit your name or email through a social media lead generation form linked to a WeXL Edu campaign, that data is used solely to contact you about the advertised product.
  • Landing page and registration: Data you enter when you visit our website from an ad and register for an account.
  • Purchase flow: Data collected when you complete a transaction on the Platform.

We will never cold-call you from data collected via social media lead forms for purposes unrelated to the product you expressed interest in.

4. How We Use Data

  • Create and manage your account and deliver the purchased learning experience
  • Process payments and issue GST invoices
  • Generate personalised learning recommendations and progress reports
  • Send transactional communications — order confirmations, access details, renewal reminders
  • Send promotional communications about WeXL Edu products — you may opt out at any time
  • Improve our AI models and Platform using anonymised, aggregated data where contractually permitted
  • Comply with legal obligations and enforce our Terms of Use

We do not use individual student data for third-party advertising, profiling for commercial resale, or any purpose outside the educational objectives of the Platform.

5. Legal Basis for Processing

Under the DPDP Act 2023, we process personal data based on:

  • Consent — obtained at registration, including parental consent for minor users
  • Contractual necessity — to deliver the product you have purchased or your institution has licensed
  • Legitimate interests — platform security, fraud prevention, and aggregated analytics
  • Legal obligation — where required by Indian law, including tax and regulatory reporting

6. Social Media Advertising and Tracking B2C

  • Pixel and conversion tracking: We may use Meta Pixel, Google Tag Manager, or equivalent tracking tools on our website to measure whether an ad click resulted in a registration or purchase.
  • Custom audiences: We may upload hashed contact data (e.g., email) to advertising platforms to create custom or lookalike audiences. This data is hashed before upload and is not readable by the platform in its original form.
  • Retargeting: If you visit our website or interact with an ad without completing a purchase, you may see WeXL Edu advertisements again. You can opt out through your social media privacy settings.

7. Data Sharing and Disclosure

We do not sell personal data. We may share data with:

  • Payment gateway partners — to process transactions securely
  • Cloud hosting and technology providers — acting as data processors under binding confidentiality agreements
  • Advertising platforms — only hashed/anonymised data for campaign measurement
  • Client institutions (B2B only) — student data is accessible to authorised administrators of the relevant institution
  • Legal authorities — where required by law, court order, or government direction

8. Data Retention

  • B2C student data: Retained while your account is active and for 12 months after account closure or last activity, then deleted or anonymised
  • B2B student data: Retained for the licence period plus 3 months post-expiry
  • Transaction and payment records: Retained for 7 years as required under Indian tax law
  • Marketing lead data: Retained for up to 12 months from collection if no purchase is made, or until consent is withdrawn
  • Technical/log data: Retained for up to 12 months

9. Security of Data

We implement encryption in transit and at rest, role-based access controls, regular security assessments, and DPDP Act-aligned incident response procedures. In the event of a personal data breach, we will notify affected users and the Data Protection Board of India within 72 hours as required by law.

10. Student Data and Minor Users

Users between 13 and 18 years require a parent or guardian to register and accept these Terms on their behalf. We do not knowingly collect data from users under 13. Student data is used exclusively for educational purposes and will not be used for advertising profiling.

11. Your Rights under DPDP Act 2023

All data principals have the right to access, correct, and erase their personal data; to withdraw consent; to raise a grievance; and to nominate a representative. To exercise any right, contact our Grievance Officer at privacy@wexledu.com. We will respond within 30 days.

12. Cookies and Tracking Technologies

We use session cookies to maintain login state and user preferences. We also use analytics and advertising cookies (including Meta Pixel and Google Analytics) to measure Platform performance and advertising effectiveness. A cookie consent banner is displayed on first visit — you may accept all, reject non-essential cookies, or manage preferences.

13. Changes to This Policy

We may update this Privacy Policy from time to time. Institutional clients will be notified 30 days before material changes take effect. Individual B2C users will be notified by email and via a banner on the Platform. Continued use of the Platform after the effective date constitutes acceptance of the updated policy.
